About the practice

A Valletta practice focused on family law, with a dedicated team to guide you through your matter.

Who we are

The Family Law Practice advises on the legal side of family life in Malta, including separation and divorce, children, maintenance, property, cohabitation, annulment and family matters that cross borders.

The practice was founded by Dr Roselyn Borg and its family law work is led by Dr Patrick Farrugia, with Dr Isaac Vella Sargent also advising and representing clients. Dr Patrick Farrugia and Dr Isaac Vella Sargent meet clients, advise on family law matters, attend mediation sessions and represent clients in the Family Court. Both are warranted advocates in Malta and members of the Chamber of Advocates.

We aim to make the legal position and the steps ahead clear, so that you can make informed decisions at a difficult time.

What you can expect from us

Experience

Our advocates are experienced in family cases, from the first conversation and mediation through to hearings. Knowing how the process runs in practice means we can tell you what to expect at each step.

Empathy

People come to us at difficult times. We listen before we advise, we do not judge, and we pay attention to what matters most to you, including the wellbeing of your children.

Knowledge of the law

We keep up with changes to the legislation and to court procedures, and explain them in terms you can follow, with the law behind every piece of advice.

Clear communication

We advise and correspond in Maltese and English, whichever you are more comfortable with. We use plain language and keep you informed at every stage.

If your matter goes to court

Many family matters can be settled through mediation or agreement, and we will tell you plainly when that is the better route. But when a matter has to be argued, we prepare it carefully. Our advocates draft written submissions that set out your case clearly and precisely, and represent clients before all levels of the Maltese courts, including the Family Court.

When a case is more complicated

Family cases rarely involve family law alone. Property, business interests, debts, trusts, succession, or assets and relatives in other countries can all complicate a case. Alongside our focus on family law, we are grounded in the wider civil law, and in the EU rules on cross-border family matters, so we can look at the whole picture of your situation. Where a matter needs another professional, such as a notary, an accountant or a mediator, we will say so.

How we work

  • We start with a conversation, with no obligation to go further. See what happens at a first meeting.
  • Meet us in Valletta or online. Meetings can take place at our office or by video call, whichever suits you better.
  • We explain before you decide. The options, the steps, the time they may take and how our fees work, without promising a result.
  • Your children come first. Where children are involved, their wellbeing guides our advice.
  • We keep what you tell us confidential.

Where we can help

You can read about each area of our work under practice areas, or read our articles for plain-language guides to the law.

If you are not sure where your situation fits, send us an enquiry and we will point you in the right direction.
