Privacy notice
How we handle personal data when you visit this website or contact us.
Last updated: 13 October 2026
Who we are
This website is run by The Family Law Practice, 40/1 Old Mint Street, Valletta VLT1514, Malta (“we”, “us”). We are the controller of the personal data described in this notice. You can contact us at info@thefamilylawpractice.com.mt.
We handle personal data in line with the General Data Protection Regulation (Regulation (EU) 2016/679) and the Data Protection Act (Cap. 586 of the laws of Malta).
Who this notice is for
It covers people who visit this website or contact us, including through the enquiry form, before they become clients.
It does not cover the personal data of clients once they instruct the practice. That is covered in our engagement terms. Nor does it describe in detail our professional duty of confidentiality, which applies to everything you tell us.
What we collect, why, and our legal basis
Your enquiry
If you send us an enquiry, or contact us by email or telephone, we collect your name, your email address, your telephone number if you give one, the topic you choose, how you found us if you choose to tell us (an optional question on the form, with a short follow-up for two of the answers), and what you write in your message. We use it to reply, to understand whether we can help and to arrange a first conversation. Our legal basis is taking steps at your request before a contract (article 6(1)(b) of the GDPR), and our legitimate interest in answering enquiries (article 6(1)(f)). We use the answer about how you found us only to understand which channels reach people and to improve how we communicate, on the basis of our legitimate interest in understanding how people find us (article 6(1)(f)).
Before we can accept a matter, we run a conflict check, to make sure that acting for you would not conflict with our duties to a current or former client. For this we use the names you give us (yours, the other party’s and anyone else with a significant role in the matter), only for that check and to reply to you. Our legal basis is our legitimate interest in running conflict checks (article 6(1)(f)). Our enquiry and confidentiality notice explains what to send us and how we treat it.
Please give only what is needed to explain your situation. Family matters can involve sensitive information, such as health or private life. If you include it, you do so voluntarily, and the box you tick on the form is your explicit consent for us to use it to deal with your enquiry (article 9(2)(a)). We do not use it for any other purpose.
Technical data when you visit the site
Our hosting provider records technical data, such as your IP address, the date and time, the pages requested and your browser type, in server logs. We use it to keep the site secure and working, and to prevent abuse. Our legal basis is our legitimate interest in running and protecting the site (article 6(1)(f)).
The enquiry form uses a security check to tell people from automated programs. It is run by Cloudflare and has the same legal basis.
Cookies and analytics
We use analytics and advertising measurement cookies only if you agree to them in the cookie banner. See our cookie policy. Our legal basis is your consent (article 6(1)(a)), which you can withdraw at any time.
Who we share it with
We do not sell personal data. Within the practice, only the advocates and staff who need it can see your enquiry. We use trusted service providers to run the site and handle enquiries:
- Cloudflare hosts the site, protects it from abuse, runs the security check on the form and delivers form submissions to us.
- Resend sends your enquiry to us as an email.
- Google provides analytics and advertising measurement, only if you consent to cookies.
These providers act on our instructions and only for these purposes. We may also disclose personal data where the law requires it, or where it is necessary to establish, exercise or defend legal claims.
Transfers outside the European Economic Area
Some of these providers are based outside the European Economic Area, for example in the United States. Where that happens, we rely on safeguards the law recognises, such as the European Commission’s standard contractual clauses or the EU-US Data Privacy Framework.
How long we keep it
If you send an enquiry and do not become a client, we keep it for 12 months, so that we can deal with any follow-up, and then delete it. The exception is a matter we decline: there we keep only a limited record that a conflict check was run and the matter declined. If you become a client, we keep your records for as long as our professional and legal duties require. Server logs are kept for a short period set by our hosting provider. Analytics data is kept for the period set in our analytics settings.
Keeping it secure
The site uses an encrypted connection (HTTPS). We limit access to enquiries to the people who need them and take reasonable steps to protect personal data from loss, misuse or unauthorised access.
Your rights
You have the right to:
- ask for a copy of the personal data we hold about you;
- ask us to correct data that is wrong or incomplete;
- ask us to delete your data, in some circumstances;
- ask us to restrict how we use it, in some circumstances;
- object to our use of it where we rely on our legitimate interests;
- receive the data you gave us in a commonly used format, where that applies; and
- withdraw your consent at any time, where we rely on it. This does not affect what we did before.
To use any of these rights, write to us at info@thefamilylawpractice.com.mt. We may need to confirm who you are first. We will reply within one month.
We do not make decisions about you by automated means.
Complaints
If you are not happy with how we handle your data, please tell us first so we can put it right. You also have the right to complain to the Office of the Information and Data Protection Commissioner in Malta, or to the data protection authority in the country where you live.
